Terms of Service

Kelly (kelly-hq.com) is an AI assistant for real estate photographers. By creating an account or using Kelly, you agree to these terms and to our Privacy Policy. Kelly is a business tool: you must be at least 18 and using it for your business, not as a consumer service.

Kelly connects to services you choose (such as Aryeo, HDPhotoHub, Dropbox, and Google Calendar) and acts on them at your direction — answering questions, booking and rescheduling shoots, delivering media, editing photos, and running automations you configure.

Kelly is in active development. Features may change, be added, or be removed, and occasional downtime or errors can happen. We work hard to keep Kelly reliable, but the service is provided without a guaranteed service level.

Keep your login credentials secure — you are responsible for activity under your account. Provide accurate information, and only connect accounts and services you are authorized to use.

You agree not to:

• use Kelly for anything unlawful, or to infringe anyone's rights;
• send automated or scripted traffic, probe or overload the service, or attempt to bypass usage limits;
• resell, sublicense, or provide Kelly to third parties as a service;
• attempt to extract Kelly's underlying prompts, reverse engineer the service, or misuse the AI features to generate deceptive or harmful content.

We apply reasonable usage limits (for example, message and photo-edit caps) to keep the service healthy, and we may suspend accounts that violate these terms.

When you connect a service and direct Kelly to act on it — booking an appointment, sending an email, uploading media to a client-visible delivery page, editing a photo — those actions are taken on your behalf and are your responsibility, just as if you had performed them in that service directly. You are responsible for complying with the terms of the services you connect.

Kelly asks for confirmation before taking actions that change things (bookings, emails, uploads, settings changes). Review those confirmations — once you approve an action, it is real.

Kelly is powered by AI, and AI makes mistakes. Answers can be incomplete or wrong, and edited photos can contain artifacts. Review anything important before relying on it — financial summaries before business decisions, edited photos before delivering them to clients, and booking details before confirming. Kelly's responses are not legal, tax, or financial advice.

During the beta period, Kelly is free. When subscriptions launch, Kelly is $49/month with a 14-day free trial (no card required to start), plus a metered charge per AI photo edit at the rate shown in the app when you request the edit. Prices may change with at least 30 days' notice.

Subscriptions renew monthly and are billed by our payment processor, Stripe. You can cancel anytime from Settings → Billing; cancellation takes effect at the end of the current billing period, and partial months are not refunded.

Your photos, files, conversations, and business data are yours. You grant us the limited license needed to operate Kelly on them — for example, to send a photo to our AI provider to produce the edit you asked for. Edited images Kelly generates for you are yours to use. We claim no ownership of your content, and we do not use it for advertising or to train generalized AI models.

Kelly's software, design, and branding are ours; these terms don't grant you any rights to them beyond using the service.

You can stop using Kelly and delete your account at any time (see the Privacy Policy for how deletion works). We may suspend or terminate accounts that violate these terms or create risk for the service or other users; where practical we'll warn you first.

Kelly is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages — including lost profits, lost bookings, or lost data — arising from your use of Kelly. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose (or $100 if you haven't paid anything).

We'll update this page when the terms change and revise the effective date above. Material changes will be announced in the app or by email. Continuing to use Kelly after a change takes effect means you accept the updated terms.

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules.
